    California Requirements for Filing for a Divorce

    Before filing for divorce, you must meet the following requirements:

    • You or your spouse must be a resident of California for at least six months
    • You must be a resident of the county in which you are filing for at least three months. 
    • You and your ex-spouse must observe a waiting period of six months before the divorce is finalized. 

    If you meet these requirements, you can file a petition for divorce, which will also include financial disclosures of income, debts, and assets. The court will then set a hearing date where it will listen to the particulars of the divorce. They will make decisions regarding child custody, support, alimony, and asset division.

    Divorce Overview in California 

    California Family Code §2300 defines divorce, or dissolution of marriage as restoring the party's state to unmarried persons. This means that divorced couples regain single status. But, divorce can have significant and far-reaching consequences regarding your rights and duties.

    But first, you must meet California's residency requirements which state that one of the spouses must be a resident of California for at least six months and of the filing County for at least three months. Moreover, the spouses must wait for at least six months before the divorce is finalized. 

    California is a no-fault state, which means that the petitioning spouse doesn't need to prove wrongdoing to get divorced. They may simply cite irreconcilable differences or legal incapacity, and divorce will be finalized even if the other spouse doesn't want it.
